KNOXVILLE, Tenn. — Call it a technicality: THC is simultaneously legal and illegal in Tennessee, depending on what number you put on it and what plant you remove it from.

“It's something you're buying that's legal versus something you're buying that’s illegal, ” said Neal Murphy, owner of eVape Hang in Powell. "Everyone's familiar with the CBD, and they're familiar with the pot Delta 9, but there are a lot more cannabinoids in the plant other than just those. ”

Delta 8 THC are now able to be available on store shelves in the form of gummies, syrups, vapes, joints and chocolate bars -- and it gives a similar but more gentle high compared to Delta 9. Because it falls into a dreary area based on the plant it's produced from, Delta 8 products are all legal to sell and consume in Tennessee.

The USDA’s 2018 Farm Bill which allowed hemp to be grown and sold made this possible. Hemp, and the products produced from it like CBD, are now legal in Tennessee.

“Now, with Delta 8 from pot, that's illegal. With it from hemp, it’s a hemp product, and that's why it's legal, ” Murphy said. "It's not really much a loophole in the law, it's just legal issues. ”

So just why are not Delta 8 THC products raced to the shelves years ago alongside CBD after the farm bill was passed? Up until recently, CBD produced from hemp had been driving the majority of sales because it is easy to remove in significant amounts.

CBD is THC's non-psychoactive relative found in both hemp and pot plants, but hemp has a more achieable concentration of CBD where pot contains more THC. Most CBD products derived from hemp still contain small find amounts of natural THC that can't get you high.
